Thomas R. Duffy

Mr. Duffy’s practice for over 30 years has emphasized complex commercial litigation in federal and state trial and appellate courts, including substantial experience in insolvency and creditors’ remedies problems in both bankruptcy and state courts, construction defect litigation, agricultural industry litigation, investor fraud matters, anti-trust/unfair competition litigation, estate/trust litigation, general business matters, as well as serving as a mediator. Mr. Duffy has been rated an “AV Preeminent” attorney through Martindale-Hubbell®, in which his peers have recognized him as having the “Highest Possible Rating in Both Legal Ability & Ethical Standards” .

Mr. Duffy has been lead counsel in cases before the United States Supreme Court, the Ninth Circuit Court of Appeals, the Bankruptcy Appellate Panel of the Ninth Circuit, and various matters in the California Courts of Appeal.  Mr. Duffy was admitted to practice in 1975, attended Dartmouth College and Stanford University (A.B. 1971), the University of Southern California Law Center and Boalt Hall (J.D. 1975), was selected for the USC Law Review, and was a member of the Industrial Relations Law Journal.  Mr. Duffy is a member of the California State Bar and the United States Supreme Court Bar Association.  He is admitted to practice before the US Supreme Court, the Ninth Circuit, and the federal courts in the Northern, Eastern, and Central Districts of California.

Published cases include Karahalios v. National Federation of Federal Employees, 489 U.S. 527, 533-34, 109 S.Ct. 1282, 103 L.Ed.2d 539 (1989); In re Jercich, 238 F.3d 1202 (9th Cir. 2001).

Mr. Duffy serves as a court appointed mediator for the Monterey County Superior Court, and as a mediator on the Bankruptcy Dispute Resolution Panel for the Northern District of California bankruptcy courts.
